Delivery Service Agreement
This Delivery Service Agreement ("Agreement") is made between Deally.co.uk ("Company", "We", or "Us") and the customer ("You" or "Customer") who engages in the purchase of goods from Deally.co.uk. This Agreement outlines the terms and conditions under which the Company agrees to deliver goods to the Customer.
The terms may be updated as necessary in the future.
1. Delivery Terms
1.1. Delivery Options:
We offer various delivery methods which may include standard delivery, express delivery, and next-day delivery, depending on the location and availability. Delivery options are presented at checkout.
1.2. Delivery Charges:
Delivery fees vary based on the delivery option selected, the size and weight of the goods, and the destination. All delivery charges will be clearly outlined during checkout before confirming your order.
1.3. Delivery Timeframe:
Estimated delivery times are provided based on the selected delivery method. We make every effort to ensure timely delivery, but actual delivery times may vary due to factors beyond our control (e.g., weather, courier delays).
Standard Delivery: 4-7 working days.
Express Delivery: 2-3 working days.
Next-Day Delivery: Orders placed before 10:00 will be delivered the next working day.
2. Delivery Address. Only orders with delivery addresses within the UK mainland will be processed. Orders with delivery addresses outside the UK mainland will be canceled.
2.1. Accuracy of Delivery Information:
You are responsible for providing accurate delivery details. We are not liable for delivery delays or failures due to incorrect or incomplete delivery information provided by the Customer.
2.2. Changing Delivery Address:
If you wish to change your delivery address after placing an order, please contact us immediately. Changes to the delivery address may not be possible if the order is already in transit.
3. Delivery of Goods
3.1. Receipt of Goods:
Upon receipt, you are required to inspect the goods for any damages or discrepancies. If any issues are discovered, you must notify us within 24 hours of delivery.
3.2. Failed Deliveries:
If a delivery attempt fails due to your unavailability, the courier may leave a card or attempt redelivery. After multiple failed attempts, the item may be returned to us, and any additional delivery costs may be charged to the Customer.
4. International Delivery
4.1. Availability:
We currently offer international shipping to selected countries. The availability and terms of international shipping may change from time to time.
4.2. Customs and Import Duties:
You are responsible for any customs duties, taxes, or fees associated with international deliveries. We are not responsible for delays caused by customs processing.
5. Cancellations and Refunds
5.1. Cancellation of Orders:
Orders can only be canceled before they are dispatched. Once an order is dispatched, it cannot be canceled, and you will need to follow the returns procedure as outlined in our Return Policy.
5.2. Refunds for Delivery Charges:
If an order is canceled before dispatch or is returned to us in accordance with our return policy, delivery charges may be refunded based on the circumstances.
6. Liability and Risk
6.1. Risk of Loss:
Risk in the goods passes to you upon delivery. We are not liable for any loss or damage to goods after delivery unless it is due to our negligence.
6.2. Limitation of Liability:
To the maximum extent permitted by law, we are not liable for any indirect or consequential loss arising from delivery delays, failure, or the condition of the goods upon delivery.
7. Force Majeure
We are not liable for delays or failures in delivering goods due to circumstances beyond our control, such as natural disasters, strikes, transportation issues, or acts of government authorities.
8. Amendments to this Agreement
We reserve the right to amend or update this Agreement at any time. Any changes will be effective immediately upon posting on our website.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales, and any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
